Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Soften Sleep mobile application (the "App"), provided by Reklit BV ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the App, you confirm that:
- You are at least 13 years old (or the minimum age required in your jurisdiction)
- You have read, understood, and agree to these Terms
- You have read and understood our Privacy Policy
- You are using the App for personal, non-commercial purposes
2. License to Use the App
2.1 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use, subject to these Terms and the Apple App Store Terms of Service.
2.2 Restrictions
You may NOT:
- Modify, reverse engineer, decompile, or disassemble the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any portion of the App
- Copy, distribute, or create derivative works from the App
- Use the App to provide services to third parties
3. Subscription Terms
3.1 Subscription Plans
The App offers the following subscription options:
- Annual Plan: $69.99/year
- Monthly Plan: $9.99/month
- Duo Annual Plan: $89.99/year
3.2 Introductory Offers (If Available)
- Some subscriptions may include introductory pricing or trial periods depending on App Store configuration and territory
- If an introductory offer is available, terms are shown in the App Store purchase sheet before you confirm
- If no introductory offer is shown, standard pricing applies immediately
3.3 Payment and Billing
- Payment is processed through Apple's App Store
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your Apple account will be charged within 24 hours prior to the end of the current subscription period
- Prices may change with notice; existing subscriptions continue at the original price until renewal
3.4 Cancellation
- You can cancel your subscription at any time through your Apple ID settings
- Cancellation takes effect at the end of the current billing period
- You will retain access to premium features until the end of the paid period
- No partial refunds are provided for cancellations mid-period
3.5 Refunds
- All purchases are processed through Apple's App Store
- Refund requests must be made to Apple directly via reportaproblem.apple.com
- We do not have access to process refunds directly
- Apple's refund policies apply
3.6 Duo Plan Access
- The Duo Annual plan is designed for two sleepers within one household
- Duo sharing is managed through Apple Family Sharing when available for this subscription and territory
- To share: the subscription organizer adds the partner to their Apple Family group, and the partner installs Soften and taps Restore purchases in Settings
- The subscription organizer is responsible for all charges
- Both users must comply with these Terms
4. Free Session Limit
- Non-subscribers receive 2 free breathing sessions
- The free session is consumed after you complete the first guided breathing cycle of a rescue session
- After exhausting free sessions, a subscription is required to continue
- Free session counts are stored locally on your device and cannot be reset
5. Your Use of the App
5.1 Acceptable Use
You agree to use the App:
- In accordance with all applicable laws and regulations
- For personal wellness and relaxation purposes only
- Responsibly and at your own discretion
5.2 Audio Guidance
The App can play optional audio guidance for breathing cues. In the current version:
- No microphone recording feature is included
- No speech transcription feature is included
- No voice recordings are transmitted to our servers or third parties
6. Intellectual Property
All content, features, and functionality of the App, including but not limited to:
- Text, graphics, logos, and design elements
- Audio guidance and breathing protocols
- Software code and algorithms
- User interface and user experience design
are the exclusive property of Reklit BV and are protected by copyright, trademark, and other intellectual property laws.
7. Data and Privacy
- Your in-app preferences and session history are stored locally on your device
- You can export on-device data and delete on-device data at any time via Settings
- Subscription status and purchase events are processed through Apple and RevenueCat
- Optional anonymous analytics may be processed when enabled; you can disable analytics in Settings to stop future collection
- We do not collect or store personal health information on our servers

8. Wellness Disclaimer
IMPORTANT INFORMATION
Soften Sleep is a general wellness application designed to support relaxation and sleep. It is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.
The breathing exercises and cognitive techniques offered in the App are based on commonly used relaxation practices. Individual results may vary.
If you are experiencing persistent sleep difficulties, anxiety, mental health concerns, or any health condition, please consult a qualified healthcare professional.
Soften Sleep does NOT provide medical advice. The information and features in this App are for general wellness purposes only and should not be used as a substitute for professional medical care.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
- WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES, SLEEP QUALITY, OR WELLNESS RESULTS
- YOUR USE OF THE APP IS AT YOUR OWN RISK
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Reklit BV, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
11. Termination
11.1 By You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling your subscription (if applicable)
11.2 By Us
We may suspend or terminate your access to the App immediately, without prior notice, if:
- You breach these Terms
- We are required to do so by law
- We discontinue the App (with reasonable notice)
12. Changes to the App and Terms
12.1 App Updates
We may update, modify, or discontinue the App at any time, with or without notice. We are not liable for any changes or discontinuation of the App.
12.2 Terms Updates
We may update these Terms from time to time. We will notify you of material changes by:
- Updating the "Last Updated" date at the top
- Displaying an in-app notification
Your continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
13.1 Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- First, good faith negotiation between the parties
- If unresolved, through binding arbitration in the Netherlands
14. Third-Party Services
The App uses the following third-party services:
- Apple App Store: For app distribution and payment processing (Apple's terms apply)
- RevenueCat: For subscription management (RevenueCat's terms apply)
We are not responsible for third-party services or their terms.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reklit BV regarding the App.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
15.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer these Terms. We may assign these Terms to any successor or affiliate.
